Terms and Conditions

 

With the placement of each order, you agree to the acceptance of the following terms and conditions. These terms and conditions shall supersede any subsequent terms and conditions included in any purchase order unless agreed to in writing by Xtreme Visibility Canada.

PRICING & SPECIFICATIONS

  1. All merchandise are priced in Canadian Dollars and are FOB our Toronto warehouse (unless otherwise advised).
  2. Price does not include applicable federal and provincial taxes nor does it include courier/freight charges.
  3. Price(s) are subject to change(s) without notice.

PAYMENT TERMS

Merchandise must be paid in full before released for shipment. We accept Master Card or Visa Card.

SHIPPING

  1. Most in-stock merchandise are shipped within 24 hours via Canpar. Other carriers are available and could be subject to additional charges.
  2. Shipping and handling charges will appear on your invoice.
  3. Merchandise shipped to the USA will be subject to additional Duty, Customs clearance and freight fee.
  4. We are not responsible for delays in delivery due to carrier, customs or other circumstances beyond Xtreme Visibility Canada’s control.
  5. We reserve the right to limit quantities available for sale or sold.

DAMAGED SHIMPENTS; RISK OF LOSS

Customer should thoroughly inspect all merchandise for shipping damage before accepting delivery. If damage has occurred, Customer should note the extent of the damage on the freight bill and contact Xtreme Visibility Canada immediately.

RETURNS AND CLAIMS

  1. All returns by must have Return Authorization Number (RA). Please contact Xtreme Visibility Canada for RA number.
  2. All Returned merchandise must be shipped prepaid.
  3. Before decorating merchandise, it is the Customer’s responsibility to inspect all merchandises for correct style, colour and size. Merchandise that have been decorated, washed or altered are not returnable or refundable.
  4. Defective merchandise must be reported within 10 business days of shipping.
  5. All merchandise returned must be in original packaging and in good condition, otherwise a 20% restocking fee will apply.
  6. We reserved the right to inspect all merchandise returned before credit is issued.
  7. Merchandise returned 30 days after ship date are subject to 20% restocking fee.

CONTROLLING LAW

The validity, construction and enforcement of the purchase agreement between Xtreme Visibility Canada and the Customer shall be governed and interpreted in accordance with the laws of the Province of Ontario, Canada

LIMITATION OF LIABILITY

  1. The sole and exclusive maximum liability to Xtreme Visibility Canada shall be the price of the product ordered.
  2. Xtreme Visibility Canada shall not be liable under any circumstance for consequential or incidental damages, including but not limited to, labour costs and loss of merchandise arising in connection with the use of or inability to use merchandise purchased from Xtreme Visibility Canada.
  3. Xtreme Visibility Canada shall not be liable for any delay in or impairment of performance resulting from any circumstance or causes beyond its control in the conduct of its business (force majeure).

MISPRINTS AND ERRORS, AND PRODUCT AVAILABILITY

  1. Xtreme Visibility Canada endeavours to provide current and accurate information on the website. However, misprints, errors, inaccuracies, omissions (including incorrect specifications of our merchandise or other errors may sometimes occur. Xtreme Visibility Canada cannot guarantee that merchandise and services advertised on the Website will be available when ordered or thereafter.
  2. Xtreme Visibility Canada reserves the right to:
    1. correct any error, inaccuracy or omission at any time without prior notice or liability to you or any other person;
    2. change at any time the merchandise and services advertised or made available for sale on the Website, the prices, fees, charges and specifications of such merchandise and services, any promotional offers and any other Website content without any notice or liability to you or any other person;
    3. reject, correct, cancel or terminate any order, including accepted orders for any reason and
    4. limit quantities available for sale
